Introduction

NC Mountain Trail Runners, a division of the Run828 Foundation (“NCMTR”, “us”, or “our”) respects the privacy of our users (“user”, “you”, or “your”). This privacy policy (the “Policy”) explains how we collect, use, disclose, and safeguard your information when you visit ncmtr.org or any connected technology (collective, the “Site”). Please read this Policy carefully. If you do not agree with the terms of this Policy, please do not access the Site.

NCMTR reserves the right to make changes to this Policy at any time and for any reason. NCMTR will alert you about any changes by updating the “Last Updated” date of this Policy. Any changes or modifications will be effective immediately upon posting the updated Policy on the Site, and you waive the right to receive specific notice of each such change or modification.

You are encouraged to periodically review this Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Policy by your continued use of the Site after the date such revised Policy is posted.

Collection of Information

NCMTR may collect personally identifiable information such as your name and email address, and demographic information such as your age and gender that you voluntarily give NCMTR when you register for the Site or participate in various activities related to the Site. Registration for the Site requires use of your real name and a valid email address.

Derivative data such as your IP address, browser type, operating system, access times, and the pages you view may be automatically collected by servers under the control of NCMTR.

NCMTR makes use of a third-party platform called Stripe for handling all billing, subscriptions, memberships, payments, and other related functionality. Financial information including payment method data entered during registration is transmitted directly between your browser and Stripe using a product called Stripe Elements. The servers hosting ncmtr.org do not store or otherwise have access to complete payment method information and are limited to seeing only the brand, last four (4) digits, and expiration date of any payment method.

NCMTR may also collect any information you make available via your account settings or via content you create and/or upload during your use of the Site.

Use of Information

At present, NCMTR limits the use of your personal information to the internal administration of the Site and of NCMTR itself. These uses may include, but are not limited to:

  1. Assisting law enforcement and responding to subpoenas.
  2. Compile anonymous statistical data for use internally or with third parties.
  3. Create and manage your account.
  4. Email you regarding your account and/or membership.
  5. Fulfill and manage transactions related to the Site.
  6. Monitor and analyze usage and trends.
  7. Notify you of updates to the Site and/or regarding NCMTR.
  8. Prevent fraudulent transactions and other criminal activity.
  9. Process payments and refunds.
  10. Respond to customer service requests.

NCMTR does not use personal information to deliver targeted advertisements, affect content visibility, or otherwise personalize the experience offered by the Site.

Disclosure of Information

If NCMTR believes the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, NCMTR may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction.

NCMTR may share anonymous statistical data, such as the number of members, with third party entities including, but not limited to, sponsoring organizations, the press or other media, and other entities associated with the sport of trail running. NCMTR will not share personal information with these entities without your consent.

While making use of the Site, your name will be visible to other registered users of the Site. Parts of the Site disclosing your name are not available to the general public and visibility of these parts is limited to registered users of the Site.

Cookies and Web Tracking

The Site uses cookies for the purposes of session management and other basic functionality. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Site.

NCMTR does not track users across sites outside of the direct control of NCMTR and does not use information associated with cookies to deliver targeted advertisements, affect content visibility, or otherwise personalize the experience offered by the Site.

Information Security

NCMTR uses administrative, technical, and physical security measures to help protect your personal information. While NCMTR has taken reasonable steps to secure the personal information you provide, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, NCMTR cannot guarantee complete security if you provide personal information.

Options Regarding Your Information

At any time you may review or change the information in your account by logging into the Site and accessing your account settings. If you wish to terminate your account, you may do so by contacting NCMTR at admin@ncmtr.org. Upon your request to terminate your account, we will deactivate your account and remove access to any content generated and/or uploaded by you during your use of the site. Some of this data may be retained in our databases to prevent fraud, troubleshoot problems, assist with any investigations, and/or comply with legal requirements.

If you no longer wish to receive correspondence, emails, or other communications from NCMTR, you may opt out by logging into the Site and adjusting your notification preferences in your account settings. While you are an active NCMTR member, you may not opt out of correspondence regarding the status of your membership or any transactions associated therein.
